A premodern legacy: the "easy" criminalization of homosexual acts between women in the Finnish Penal Code of 1889.

Homosexual acts between women were criminalized in Finland in the 1889 Penal Code which also criminalized men's homosexual acts for the first time explicitly in Finnish legislation. The inclusion of women in the Penal Code took place without much ado. In the article it is argued that the uncomplicated juxtaposing of men and women was due to the legacy of a cultural pattern where man and woman, as categories, were not in an all-pervasive polarity to each other, for example, in sexual subjectivity. Human traffickers frequently take advantage of operative protocols that make them unpunishable pursuant the Italian Criminal Law because according to Art. 6 of the Italian Penal Code and International Convention on the High Sea jurisdictional powers cannot be exercised when the conduct is committed on the High Sea. So illustrating the territorial limitations of the efficacy of Criminal Law the research focuses on the hermeneutical solution given by the Court of Cassation that apparently with the intent of pursuing a more effectivity of the Criminal response recurred to the controversial category of the indirect offender in order to sanction smuggling conducts that enjoy the rescue intervention of the Italian authorities to reach their criminal aims. In turn in order to better identify the Italian jurisdiction in the crime of Art. 12 T.U. imm. I propose to correctly apply the concorso di persone (art. 110 c.p.) and the reato eventualmente permanente. Carmen de Burgos died in 1932, leaving behind a considerable amount of written material: thousands of articles published in different newspapers, essays, novels and hundreds of “novelas cortas”. The works and the memory of this women’s rights activist were doomed to oblivion during Franco’s dictatorship. This thesis aims to rediscover and analyse these works from its various perspectives. We have been looking for the constant trends but also the evolutions. Carmen de Burgos has indeed evolved in her conception of the woman’s role and of the rights she had to acquire.
